GEORGETOWN, Texas (KXAN) — A Williamson County judge has approved a motion to keep Greg Kelley in the county jail until at least Aug. 1.

The move comes after new defense attorney Keith Hampton filed a motion to keep the 19-year-old there until a motion for a new trial can be heard.

Kelley was convicted of super aggravated sexual assault of a child for incidents at an in-home day care earlier this month and was sentenced to 25 years behind bars as part of a punishment agreement. He also surrendered his right to appeal as part of the agreement.

Hampton said filing a motion for a new trial is different than an appeal because it is handled by the trial court and not the Third Court of Appeals.

Before the case went to trial, Kelley was given an opportunity to avoid prison time altogether, yet he declined. He maintained his innocence and turned down an offer of 10 years probation which would have also required him to register as a sex offender for 20 years.

The Williamson County District Attorney Jana Duty and Assistant D.A. Mark Brunner did not return calls Friday. A receptionist eventually said they had no comment on the new developments in the case.
